SMS & Messaging Policy
Effective date: January 1, 2025
1. Purpose
The purpose of this SMS & Messaging Policy is to ensure that all text‑messaging features of CrewCheck are used lawfully, responsibly, and in a manner that protects both recipients and customers from regulatory risk.
2. Scope
This policy applies to all customers, end‑users, and any messages transmitted through the CrewCheck platform or any integrated third‑party messaging service.
3. Customer Obligations
Customers are solely responsible for:
- Obtaining and documenting valid consent from each message recipient in compliance with the TCPA, CTIA, and any applicable state laws. CrewCheck provides a standard consent form template for this purpose.
- Honouring STOP, HELP, or other opt‑out requests immediately and without delay.
- Providing clear opt‑in and opt‑out disclosures to recipients before any message is sent.
4. CrewCheck's Role
CrewCheck provides the technical infrastructure for message transmission but does not act as the sender of the content. We do not assume liability for the legality of the messages or the adequacy of the consent obtained by customers.
5. Message Content Standards
The following content is prohibited:
- Any unlawful, fraudulent, or deceptive material.
- Marketing or promotional messages sent without verified recipient consent.
- Profanity, hate speech, or adult content that is not appropriate for a business communication platform.
6. Carrier and Regulatory Compliance
We adhere to carrier rules, CTIA best practices, and Twilio's Acceptable Use Policy. All messages must comply with these standards, and any violation may result in carrier restrictions or suspension of service.
7. Opt‑In and Opt‑Out Requirements
Customers must meet the minimum standards for consent, which include:
- Obtaining explicit, written or electronic consent that clearly states the purpose of messaging.
- Including a clear and easy‑to‑use STOP or HELP command in every outbound message.
- (Optional but recommended) Sending a confirmation message after a recipient opts in.
8. Recordkeeping
Customers must retain records of all opt‑in and opt‑out events, including timestamps and the method of consent. Signed consent forms (using our standard template or equivalent) must be retained for the duration of the relationship plus 4 years. These records must be made available to CrewCheck or regulators upon reasonable request.
9. Enforcement and Suspension
CrewCheck monitors usage for compliance. Upon detection of a violation, we will issue a notice and may suspend the offending account. Repeated or severe violations can lead to permanent termination of service.
10. Liability Disclaimer
CrewCheck disclaims any liability for fines, penalties, or other regulatory actions that arise from a customer's misuse of the messaging service or failure to obtain proper consent.
11. Changes to Policy
We reserve the right to modify this SMS & Messaging Policy at any time. Updates will be posted on the dashboard and communicated via email. Continued use of the service after such changes constitutes acceptance of the revised policy.
